| Outstanding professors and researchers | You must demonstrate international recognition for your outstanding achievements in a particular academic field. You must have at least 3 years experience in teaching or research in that academic area. You must be entering the United States in order to pursue tenure or tenure track teaching or a comparable research position at a university, institution of higher education, or private employer. | You must meet at least 2 of the 6 criteria listed below** and provide an offer of employment from the prospective U.S. employer. To qualify for the EB-1A category, the individual must be a leader in at least one of the listed areas:
- Sciences
- Arts
- Education
- Business
- Athletics
Criteria to qualify for EB1-A: Meet 3 of the 10 listed criteria below
- Evidence of **receipt of lesser nationally or internationally recognized prizes or awards** for excellence
- Evidence of your membership in associations in the **field which demand outstanding achievement** of their members
- Evidence of **published material about you in professional or major trade publications** or other major media
- Evidence that you have been asked to **judge the work of others**, either individually or on a panel
- Evidence of your **original scientific, scholarly, artistic, athletic, or business-related contributions** of major significance to the field
- Evidence of your **authorship of scholarly articles in professional or major trade publications** or other major media
- Evidence that your work has been displayed at artistic exhibitions or showcases
- Evidence of your **performance of a leading or critical role in distinguished organizations**
- Evidence that you **command a high salary** or other significantly high remuneration in relation to others in the field
- Evidence of your commercial successes in the performing arts
### EB1-B
Outstanding researchers and professors. PhD applicants, scientists in the field important to USA.
### EB1-C

- **Harsh call**: L1A is inter-company transfer - e.g. Dell Canada to Dell USA
If you’re a manager category then you’ll be transferred on L1A
Function Manager is if there’s only one person and important for the company, then you can qualify for function manager.
You can define an important area and be a manager of that area or function.
Behavioral attributes - working independently with little to no direction. High enough in the org to justify that you’re a manager.
USCIS defines international employee as someone working in Dell XYZ outside USA for 1 year (excluding days you’re in USA for personal/work purposes)
You need lawyers to say that you were performing as a manager outside USA and continue working as manager when in USA.
L1A doesn’t need to go through labor verification cause you’re considered high enough. So your i140 is applied immediately in EB1.
Tradeoffs: Have to stay with the firm, work permit is attached with the firm. Cannot change jobs.
Convince manager that you’re going out of USA and come back in USA after a year. I want to do some research, want to talk to lawyers
